These Terms of Service apply to your use of the You Can’t Make It Up website and to purchases made through our online store. “We”, “us” and “our” refer to Monk Enterprises Pty Ltd, trading as You Can’t Make It Up, ABN 67 692 045 453.

1. Acceptance of these terms

By using this website or placing an order, you agree to these terms and our Privacy, Shipping and Returns and Refund policies. If you do not agree, do not use the website or place an order.

2. Eligibility and acceptable use

You must use the website lawfully and must not interfere with its security, operation or availability. You must not introduce malicious code, attempt unauthorised access, misuse another person’s information or use the website for fraudulent activity.

3. Product information

We take reasonable care to describe and display products accurately. Screen settings and production processes may cause minor differences in colour, placement or appearance. Garment measurements may vary within the manufacturer’s stated tolerances.

Product images may include digital mockups. The final product may have reasonable differences resulting from garment shape, size and the printing process. These statements do not limit any consumer guarantee.

4. Made-to-order production

Products are produced after an order is placed. Customers should review product details, colour choices and size guides carefully before checkout. Change-of-mind returns are handled under our Returns and Refund Policy.

5. Orders

Submitting an order is an offer to purchase. We may accept or decline an order, including where a product or price is incorrect, payment is not authorised, supply is unavailable, or fraud is reasonably suspected.

An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance. If we cancel an order after payment, we will refund the amount paid for the cancelled item or order.

6. Prices and payment

Prices are displayed in Australian dollars. Any applicable taxes and shipping charges will be shown at or before checkout. Payment must be completed using an available checkout method.

We may correct genuine pricing or listing errors. We will contact you before proceeding where a correction materially affects an order.

7. Shipping

We currently ship within Australia only. Production, dispatch, tracking and delivery are governed by our Shipping Policy.

8. Returns, remedies and cancellations

Returns, order changes, cancellations and remedies are governed by our Returns and Refund Policy. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under Australian Consumer Law.

9. Intellectual property

Unless otherwise stated, website content, branding, graphics, product designs, photographs, video, audio and written material are owned by or licensed to us. You may use the website for personal shopping purposes only. You must not reproduce, distribute, sell, modify or commercially exploit our content without written permission.

10. Third-party services and links

Our store uses third-party services, including Shopify, payment providers, analytics providers, printers and carriers. Third-party websites and services may have their own terms and privacy practices. We are not responsible for unrelated third-party content or services, except where liability cannot lawfully be excluded.

11. Website availability

We may update, suspend or withdraw website features from time to time. We do not promise uninterrupted or error-free access. This section does not affect obligations that cannot lawfully be excluded.

12. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website. Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful.

13. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. The version published when an order is placed will apply to that order, together with any rights that apply under law.

15. Governing law

These terms are governed by the laws of Victoria, Australia. Courts and tribunals with jurisdiction in Victoria may hear disputes, subject to any rights a customer has to bring a claim elsewhere under applicable law.

YCMIU FIRST-ENTRY REIMBURSEMENT OFFER TERMS AND CONDITIONS

1. Promoter

The promoter is Monk Enterprises Pty Ltd, ABN: 67 692 045 453 , of Southbank, Victoria 3006, Australia, trading as You Can’t Make It Up (“YCMIU”).

2. Offer Period

This is an ongoing offer commencing when it is first published by YCMIU. No fixed closing date applies.

YCMIU may withdraw the offer by publishing reasonable notice on its website or social-media pages. Withdrawal will not affect an eligible purchase made before the published withdrawal time, provided all other requirements are satisfied.

All dates and deadlines under this offer are determined using the local time in Melbourne, Victoria, Australia, whether that is Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT).

3. Eligibility

To participate, a person must:

a. be aged 18 years or over;
b. reside in Australia;
c. purchase at least $100 AUD of eligible YCMIU merchandise in a single transaction through YCMIU.com.au while the offer is available;
d. be the person named on the qualifying purchase; and
e. comply with these Terms and Conditions.

The $100 minimum is calculated after discounts and excludes delivery charges, gift cards and merchandise that is subsequently returned or refunded.

4. Qualifying Tournament

A qualifying tournament must:

a. be conducted at a physical venue in Australia;
b. have a final table that is officially live-streamed or publicly broadcast by the tournament organiser or its authorised broadcaster; and
c. award the participant first place in its official results.

Private games, online-only tournaments, satellites, promotional freerolls and tournaments without independently verifiable results are not eligible.

The qualifying purchase must be completed before the participant’s first paid entry into the qualifying tournament.

5. Reimbursement

An eligible participant who wins a qualifying tournament may claim reimbursement of the rake or administration fee charged on the participant’s first paid entry into that tournament, up to a maximum of $250 AUD.

“First paid entry” means the first tournament entry or starting flight paid for and used by the participant in the qualifying tournament.

The reimbursement does not cover:

a. any portion of the entry payment allocated to the tournament prize pool;
b. re-entries or additional starting flights;
c. rebuys or add-ons;
d. optional staff charges or gratuities;
e. card-processing or payment fees;
f. travel or accommodation; or
g. any other associated costs.

If the rake or administration fee charged on the first paid entry is less than $250, only the amount actually paid for that fee will be reimbursed.

If the rake or administration component cannot be identified or reasonably verified, YCMIU may request further evidence before approving the claim.

Only one reimbursement may be claimed per person and per qualifying purchase. A qualifying purchase cannot be transferred to another person or used for multiple claims.

6. Social-Media Requirements

When submitting a claim, the participant must be following:

a. the YCMIU Facebook page at facebook.com/youcantmakeitupcommentary; and
b. the YCMIU Instagram account at instagram.com/ycmiucommentary.

The participant may be required to provide reasonable evidence that these requirements have been satisfied.

7. Merchandise Requirement

The participant must be visibly wearing merchandise included in the qualifying YCMIU purchase in the official winner’s photograph.

The merchandise and its YCMIU branding must be reasonably identifiable in the photograph. Wearing an item that was not included in the participant’s qualifying purchase does not satisfy this requirement.

8. How to Claim

The participant must email the claim to monkey@ycmiu.com.au within 10 calendar days after the qualifying tournament officially concludes.

The claim must include:

a. the participant’s full name and contact details;
b. the YCMIU order number and proof of purchase;
c. proof of the first entry payment;
d. evidence showing the rake or administration fee charged;
e. the tournament’s name, venue and dates;
f. a link to the official tournament results;
g. a link to or recording of the official final-table live stream;
h. the official winner’s photograph showing the participant wearing the qualifying merchandise; and
i. any other reasonable information required to verify eligibility.

A claim received more than 10 calendar days after the tournament concludes will not be eligible. Incomplete claims may be rejected if YCMIU cannot reasonably verify that all requirements have been satisfied.

9. Claim Assessment and Payment

YCMIU will notify the participant by email whether the claim has been approved or rejected.

An approved reimbursement will be paid in Australian dollars within 10 business days after the participant is notified that the claim was successful.

Payment will be made by [BANK TRANSFER/OTHER PAYMENT METHOD]. The participant must provide accurate payment details. YCMIU is not responsible for delays caused by incorrect or incomplete information supplied by the participant.

10. Returns and Cancellations

A participant will cease to be eligible if the qualifying purchase is cancelled, refunded or returned and the value of the merchandise retained from that transaction falls below $100.

Nothing in these terms excludes or limits any rights or remedies available under the Australian Consumer Law.

11. Verification and Disqualification

YCMIU may reasonably verify any purchase, entry payment, fee, tournament result, live stream, photograph or claim.

A participant may be disqualified for providing false, altered, misleading or fraudulent information or for otherwise failing to comply with these terms. All claim decisions will be made reasonably and on the available evidence.

12. Privacy and Publicity

Personal information will be collected and used to administer and verify the offer and to pay approved claims.

With the participant’s separate permission, YCMIU may publish or repost the winner’s name, image and tournament details for promotional purposes. Participation does not automatically provide consent for unrelated marketing.

13. General

This offer is not sponsored, endorsed, administered by or associated with any poker tournament or series organiser, Facebook, Instagram or Meta.

YCMIU may amend, suspend or withdraw the offer where reasonably necessary, subject to applicable law. A change will not unfairly prejudice a participant who completed the relevant qualifying requirements before the change was published.

Participants are responsible for complying with tournament rules and all applicable laws. YCMIU does not encourage excessive gambling. Participants must be at least 18 years old and should gamble responsibly.
